These Terms of Service ("Terms") constitute a legally binding agreement between you and Front Terrain ("Front Terrain", "we", "us" or "our"). By accessing or using the website, applications, or services made available by Front Terrain (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
In these Terms: "Content" means text, images, video or other material available through the Service; "User Content" means Content you submit or post; "Account" means your user account on the Service.
You must be at least 13 years old (or the minimum age required in your jurisdiction) and legally capable of entering into contracts to use the Service. By registering or using the Service you represent and warrant that you meet these eligibility requirements.
We may modify, restrict, suspend, or discontinue the Service (or any part) at any time without liability or prior notice. We may also impose limits on certain features or restrict your access to parts or all of the Service without liability or prior notice.
You agree to provide accurate and complete information when creating an Account and to update that information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your Account. Notify us immediately of any unauthorized use or security breach involving your Account.
When using the Service you must not (including through User Content):
You retain ownership of User Content you post, subject to the licenses you grant in these Terms. By submitting User Content you grant Front Terrain a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, copy, distribute, modify, create derivative works of, publicly display and otherwise use your User Content for the purpose of operating, providing, improving, and promoting the Service. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate these Terms.
All intellectual property rights in the Service and its content (excluding User Content) are owned by or licensed to Front Terrain. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
Some features of the Service may be offered for a fee. If you purchase paid services, you agree to the applicable fees and payment terms. All fees are non-refundable unless stated otherwise. You are responsible for any taxes associated with your purchases.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, Front Terrain DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON‑INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by applicable law, IN NO EVENT SHALL FRONT TERRAIN, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO FRONT TERRAIN FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
You agree to indemnify, defend, and hold harmless Front Terrain and its affiliates, officers, directors, employees and agents from and against any claims, liabilities, losses, damages, and expenses (including reasonable attorneys' fees) arising from or related to your breach of these Terms, your User Content, or your violation of any law or the rights of a third party.
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, and Miscellaneous) will survive.
These Terms are governed by the laws of the jurisdiction in which Front Terrain operates, without regard to its conflict of laws principles. To the extent you are a consumer, you may have additional rights under local law that are not waived by these Terms.
We may amend these Terms from time to time. Material changes will be posted with an updated "Last Updated" date and, where appropriate, we may notify you. Continued use of the Service after changes constitutes acceptance of the revised Terms.
These Terms, together with any policies referenced herein, constitute the entire agreement between you and Front Terrain relating to the Service. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Failure to enforce a provision is not a waiver of that provision.
